United States Supreme Court Imposes Stay on OSHA Vaccine Mandate: What Does it Mean for Restaurants?

Jared Slater, an attorney in ECJ's Employment Law Department, authored the article, "United States Supreme Court Imposes Stay on OSHA Vaccine Mandate: What Does it Mean for Restaurants?," which was published by Modern Restaurant Management magazine.

The article discusses the recent petition for stay of enforcement of OSHA’s COVID-19 Vaccination and Testing; Emergency Temporary Standard that would have been imposed on employers of 100 or more employees. The stay is pending disposition of businesses, trade groups and non-profit organizations' petitions for review in the Sixth Court of Appeals. The Supreme Court determined that the petitions challenging the constitutionality of the mandate were likely to prevail. For now, employers with over 100 employees do not need to fear being cited by OSHA for non-compliance as this issue is ongoing.
