Takeaways From California COVID Dining Restrictions Ruling

Pooja S. Nair, Chair of ECJ’s Food, Beverage and Hospitality Department, published an article in Law360 titled, "Takeaways From California COVID Dining Restrictions Ruling." 

Pandemic-related restrictions have impacted the restaurant industry throughout the last year. Due to the rapidly changing nature of the pandemic and the issues responses, many of these restrictions and bans have led to court challenges. 

According to Pooja, court cases "lag behind the current situation" because of how quickly the pandemic can influence a change in restrictions. Industry advocates argue restaurants and bars have been singled out during the pandemic, however, like one appellate panel indicated, it is likely their "business interests would not prevail over public health considerations."
