Pooja Nair, Chair of ECJ’s Food, Beverage and Hospitality Department, recently published a legal update of the current laws and cases impacting the restaurant, food & beverage and hospitality industries for Modern Restaurant Management magazineHer quarterly article highlights legislative, litigative and administrative developments based on specific bills, ordinances and lawsuits from across the U.S.

This article discusses litigative developments such as the district courts siding with insurers that claim they are not responsible for losses occurring during the pandemic since they are not considered physical losses, leaving little hope for restaurants. In terms of legislation, California's AB - 286 went into effect in January 2022 making it unlawful for delivery platforms to charge consumers higher prices than advertised. The article also discusses the new announcements regarding the FDA's food and safety initiatives which strive to provide more transparency and more information about foodborne illnesses and safety hazards that directly affect consumers.
