Pooja Nair, Partner and Chair of ECJ’s Food, Beverage and Hospitality Department, was quoted on a March 17, 2022, NutraIngredients-USA article titled, “Stress: What can you claim on a product label?”

The article explains the do's and don’ts when making claims for supplements and vitamins specifically regarding claims made about stress and mental health. The FDA is on heightened alert for claims that state supplements relieve anxiety, depression or other mental health disorders.

Pooja anticipates closer agency monitoring for mental health claims based on the warning letters issued by the FDA to companies violating structure and function claims under FDA rules and the growing number of consumers using dietary supplements for mental health and stress relief. According to Pooja, "companies should be analyzing their marketing and branding" in anticipation of closer monitoring. Companies need to be mindful of the language they are using to ensure they are making appropriate claims regarding the function of supplements.
