Rule Exempts More Retail Employees From Overtime Law

Kelly O. Scott, Partner and Chair of Ervin Cohen & Jessup’s Employment Law Department, was quoted in the May 19, 2020, Daily Journal article "Rule Exempts More Retail Employees From Overtime Law". 

The article discusses a new U.S. Department of Labor rule that expands the list of retailers that can exempt their employees from overtime pay. Qualifying retail and service industry employers can exempt certain employees from overtime pay under the Fair Labor Standards Act, if they are primarily paid on a commission basis. According to Kelly, "A lot of these places could easily have a commission-based sales concept that would be very much retail-based", this ruling will give more employers fair access to the exemption.
