Peter S. Selvin, Partner in ECJ's Litigation Department, published an article in the May 5, 2020 issue of the Daily Journal. The article titled, "Ruling May Shed Light on Physical Losses and COVID-19" discusses the possibility of compensation for lost business income due to the current pandemic.

The article evaluates previous court cases to determine if the current COVID-19 pandemic may satisfy the "physical loss or damage" requirement in business interruption policies. A key issue with determining compensation for lost business is whether those policyholders suffered "direct physical loss or damage"  to their businesses.
