Kelly O. Scott, Partner and Chair of Ervin Cohen & Jessup’s Employment Law Department, was quoted in the December 3, 2019 Daily Journal article “Uber’s New Contract Language Won’t Prevent Worker Suits, Experts Say.”

The article discusses Uber’s assertion in their new driver contracts that they are a technology company – and not a transportation company, which would preclude their drivers from filing lawsuits alleging misclassification as a result of AB 5 becoming law. In order for Uber to prevail against these likely future claims, Kelly notes that, “they’re going to have to finesse the history they’ve established and get us to think that’s not what they do.” However, he goes on to explain that they wouldn’t be the first company to make such a claim.
