Los Angeles County Issues New Order Permitting Certain Businesses To Reopen

On Wednesday, May 13, 2020, Los Angeles County issued an updated “Safer at Home” order that amends and supersedes prior Los Angeles County Health Officer orders. The new order is intended to partially move Los Angeles County into the second stage of reopening businesses.

The businesses now permitted to reopen can do so only for curbside, door side, or other outdoor or outside pick-up, or delivery.  Members of the public cannot be permitted inside these businesses.  Businesses permitted to open on this basis are retailers not located in indoor malls or shopping centers, and manufacturing and logistic sector businesses that supply these retailers.

Prior to reopening, retail businesses must complete, implement and post this notice. Similarly, manufacturing and logistic businesses that support these retailers must complete, implement and post this notice prior to reopening.

The new order makes no changes with regard to essential businesses.  These businesses may remain open, but the new order emphasizes that essential businesses should ensure they have completed, implemented and posted a notice.

The order provides that all individuals who can telework should continue to do so. Further, the order strongly recommends that employers offer telework or other accommodations to all workers who are 65 or older and all individuals of any age with active or unstable pre-existing conditions.

This blog is presented under protest by the law firm of Ervin Cohen & Jessup LLP. It is essentially the random thoughts and opinions of someone who lives in the trenches of the war that often is employment law–he/she may well be a little shell-shocked. So if you are thinking “woohoo, I just landed some free legal advice that will fix all my problems!”, think again. This is commentary, people, a sketchy overview of some current legal issue with a dose of humor, but commentary nonetheless; as if Dennis Miller were a lawyer…and still mildly amusing. No legal advice here; you would have to pay real US currency for that (unless you are my mom, and even then there are limits). But feel free to contact us with your questions and comments—who knows, we might even answer you. And if you want to spread this stuff around, feel free to do so, but please keep it in its present form (‘cause you can’t mess with this kind of poetry). Big news: Copyright 2020.
