Alan Cyrlin is a Partner in ECJ's Intellectual Property Law Department. Mr. Cyrlin focuses primarily on domestic and international trademark issues, including analyzing trademark searches, preparing trademark applications, responding to trademark Office Actions, prosecuting trademark applications, maintaining trademark portfolios, and representing clients before the Trademark Trial and Appeal Board. Additionally, Mr. Cyrlin assists businesses in the fields of copyright applications, intellectual property litigation, ICANN domain name dispute resolution proceedings, and business transactions (including licensing and M&As) involving intellectual property. Representative Matters: Won a WIPO Arbitration and Mediation Center dispute concerning the client's domain name. Won an order shutting down the infringing website. Insurance Neighborhood, LLC v. Etouchcash, WIPO Case No. D2007 0293 (2007). Won a $409,675 judgment and permanent injunction in a trademark case on behalf of nail care product manufacturer. Orly International, Inc. v. William Embro et al., United States District Court Case No. CV 04-8060 SJO (RZx). Won a summary judgment in a copyright infringement action on behalf of the copyright owner of high quality gift sculptures and clocks. Secured a contempt citation against the defendant, summary judgment and recovery of $400,000 in settlement for the client. Jin Ching International v. Wong's International, 47 U.S.P.Q.2d 1509 (C.D. Cal. 1998). Won a summary judgment in a trademark infringement action on behalf of one of the largest fine tea importers in the United States . Secured an ex parte secured a seizure order, preliminary injunction, permanent injunction and judgment of approximately $850,000. Eastrise v. Kim Seng, Case No., United States District Court, Case No. CV 97 -9313 DT (RNBx). Successfully defended a computer manufacturer accused of trademark infringement. Assisted in the defeat of a preliminary injunction in trademark litigation and settlement of the case. Maximum Computers v. Maxtech, United States District Court for the Northern District of Georgia, Case No. 96-CV-3265. Successfully defended a company and individuals accused of operating a counterfeit software ring which infringed Microsoft's trademarks and copyrights. Secured a settlement for defendants. Microsoft Corporation v. Unity Group Unlimited, 51 U.S.P.Q.2D 1603 (C.D. Cal. 1999). Successfully defended a software distributor accused of, among other things, infringing Novel, Inc.'s copyrights and trademarks. Obtained summary adjudication for Defendants on copyright claim under the first sale doctrine; the case then settled on remaining claims. Novell, Inc. v. Cableware Technologies, Inc. et al, United States District Court, Case No. 99-05019 MRP (Mcx).
