Kenneth P. Hsu

Kenneth P. Hsu is a Partner in the Litigation Department.

Kenneth’s practice focuses on complex corporate, commercial, and intellectual property litigation in federal and state courts. He has represented a wide range of clients, including local and national retailers, manufacturers, and technology companies, in a diversity of contract disputes, corporate governance disputes, class actions, and other complex litigation matters. He also has experience representing clients at trial and in arbitration.

During law school, Kenneth served as editor-in-chief of the Hastings Business Law Journal. He also externed for the U.S. Securities and Exchange Commission’s Los Angeles and San Francisco Regional Offices and for the Honorable Susan Y. Illston, U.S. District Court for the Northern District of California. Prior to law school, Kenneth worked as a press aide for an elected official in New York City.

Represented chief executive officer of technology company in nine-day arbitration resulting in complete victory of claims for breach of contract and negligent misrepresentation against real estate developer.

Represented national cannabis retailer in five-day arbitration resulting in complete victory on contract claims and defense of contract, fraud, and fiduciary duty counter-claims.

Represented footwear manufacturer in high-profile trademark and trade dress infringement action, resulting in a favorable settlement – less than 1% of the initial demand – after expert discovery and dispositive motion practice.

Represented medical device company and its executive officers in successful dismissal of securities fraud class action at the pleading stage.

Represented manufacturer of wipes products against consumer fraud class action brought by several municipalities, resulting in favorable settlement during discovery.

Represented IT solutions company in contract dispute with technology company involving sensitive government contracts, resulting in favorable settlement following extensive, Court-supervised mediation.

Represented accounting firm against audit malpractice claim by municipality, resulting in favorable settlement during discovery.

Represented corporate director and officer in successful appeal of attorneys’ fees award.

Represented various companies in responding to shareholder demands and derivative claims.

Represented patent licensing company against contract and tort claims initiated by former customers, resulting in favorable settlements.
